THE COOK COUNTY EVICTION PROCESS

STEP 1: SERVING THE RIGHT NOTICE!

  • 5 Day Notice:  Non-Payment of Rent
  • 10 Day Notice:  Lease Violation
  • 30 Day Notice:  Tenant has resided in the property less than 6 months and has a month to month tenancy. 
  • 60 Day Notice:  Tenant has resided in the property 6 months- 3 years and has a month to month tenancy OR an expiring lease. 
  • 120 Day Notice:  Tenant has resided in the property 3 years+ and has a month to month tenancy OR an expiring lease. 

PROPER NOTICE MUST BE GIVEN BEFORE AN EVICTION CAN BE FILED.  Notice must be served personally to the tenant or an occupant over the age of 13. Notice cannot be posted on the door unless the property is vacant. 

After serving the notice, you must have a signed and notarized proof of service.

STEP 2: EVICTION FILING AND SERVICE

When the notice expires, a complaint and summons are filed with the Cook County Clerk of Court and Sheriff’s Department. The sheriff must attempt service of the complaint and summons before a special process server can be hired.

STEP 3: EARLY RESOLUTION PROGRAM (ERP)

All residential evictions must first have an opportunity to participate in tenant services. Those services are called the Early Resolution Program or “ERP.” The case will not be assigned to a judge until it has been properly served and the tenant has an opportunity to participate in ERP.

STEP 4: TRIAL

Every tenant has a right to trial. Residential tenants have a right to trial by jury. If no agreement is reached in ERP, the case will be transferred to a judge for trial. A trial judge will then schedule the case and a judge or jury will hear your case on the scheduled date.

STEP 5: EVICTION

Once you have been given an eviction order, it can be placed with the sheriff after the date provided by the judge. The sheriff will then remove the tenants from the property approximately 6-8 weeks after the eviction is placed.
